This application, for grant of anticipatory bail, arises out of Special Case No. 03 of 2018 arising out of Birpur P.S. Case No. 102 of 2018 disclosing offences under Sections 120B of the Indian Penal Code and Section 27b(ii) of the Drug & Cosmetic Goods Act & Section 23(a) of the N.D.P.S. Act. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the 65 of cough syrup has been recovered from the alleged vehicle, which does not come under the purview of N.D.P.S. Act. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Supaul, in connection with Special Case No. 03 of 2018 arising out of Birpur Police Station Case No. 102 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
