The petitioner is apprehending his arrest in connection with Alinagar P.S.Case No.24 of 2018 registered for offences punishable under Sections 406, 409 and 34 of the Indian Penal Code.
Allegation against the petitioner is of defalcation of Rs.2,29,980/- along with the Headmaster of the school. Submission of the learned counsel for the petitioner is that Annexure-2 discloses that the case was directed to be lodged only against the Headmaster and not against the petitioner and he has been falsely implicated in this case.
Heard learned A.P.P. , who has opposed the prayer for bail stating that the fund was withdrawn by the joint signature of the petitioner and the Headmaster as such she is also responsible for

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, if the petitioner is ready to deposit 50 % of the total amount through a Bank Draft payable in favour of the District Programme Officer and surrenders before the learned court below within a period of six weeks from the date of receipt of the order, the learned court below shall consider this aspect of the matter and will release the petitioner on bail.
