The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 448, 341, 323, 324, 308, 379 of the Indian Penal Code.

As per prosecution case, on alleged date of occurrence, the petitioner along with co-accused persons armed with weapons assaulted the informant and his family members due to which they sustained injuries.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner and the informant were next door neighbour and a dispute is going on between them due to which this petitioner has falsely been made accused in the present case. Learned

Patna High Court CR. MISC. No.71804 of 2022(2) dt.17-03-2023 2/2 counsel further submits that there is case and counter case, both parties sustained injuries as alleged in separate occurrences. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 7.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Akbarpur P.S. Case No. 148 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nawada.
