The petitioner apprehends his arrest in Sitamarhi Case No.C2-498 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The S.S.B. official seized one motorcycle loaded with 90 bottles of Nepali liquor weighing 27 litres. Learned counsel for the petitioner submits that the case was instituted against unknown after recovery of liquor from the vehicle. The petitioner is implicated only because he is the owner of the vehicle but nobody has seen the petitioner parking the vehicle near the border but it appears that the vehicle of the petitioner was seized by the S.S.B. official and from the vehicle 90 bottles of Nepali liquor weighing 27 litres

Patna High Court CR. MISC. No.67615 of 2019(2) dt.04-11-2019 2/2 were recovered.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
