Petitioner apprehends arrest in connection with Sonepur P.S. Case No. 510 2022 registered for the offence punishable under Section 30(a), 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from side of Mehura river at Shikarpur which is an open place and accessible to all. Petitioner has no concern with the seized article.

No.71937 of 2022(2) dt.12-01-2023 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Iind Exclusive Special Judge, Excise Judge, Saran at Chapra in connection with Sonepur P.S. Case 510 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
