The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a)/38(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 70.560 litres of liquor from the house of the petitioner. It is further submitted that the petitioner has one criminal antecedent for the offence under Sections147, 148, 149, 342, 323 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner further submits that other co-accused have been granted the privilege of bail in Cr. Misc. No. 7997 of 2019 on 14.02.2019 and Cr. Misc. No. 41151 of 2019 on 05.07.2019. Petitioner is languishing in judicial custody

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge Excise, Bhagalpur in connection with Dholbajja (Kadwa) Police Station Case No. 71 of 2018.
