The petitioner seeks bail in a case registered under Sections 323, 324, 325, 341, 307, 379, 447, 504/34 of the Indian Penal Code.

Allegedly, in the backdrop of constructing the house of the informant, the dispute arose and in consequence thereof, the accused persons assaulted the informant and one Mamta Devi with iron rod and Lathi, as a result of which, injuries were sustained by victims.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 18-08-2019. The nature of injury is

Patna High Court CR. MISC. No.64780 of 2019(2) dt.17-10-2019 2/2 said to be simple. There is no repetition of blow. No offence u/S 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Motihari, East Champaran in connection with Patahi P.S.
