====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-11-2025 Heard learned counsel for the petitioners and the State.
2. This petition has been filed for modification of order dated 21.07.2025 passed in Cr. Misc. No. 30051 of 2025 to the extent of correction in submission part of the aforesaid order and extension of period of surrender.
3. Learned counsel for the petitioners submits that due to inadvertence in the main petition, criminal antecedent of these petitioners has wrongly been mentioned as clean whereas, these petitioners have got one criminal antecedent bearing Sigori P. S. Case No. 143 of 2023 under Section 30(a) of the Bihar Excise and Prohibition Act, as such, same error has
Patna High Court CR. MISC. No.76518 of 2025(2) dt.28-11-2025 2/2 occurred in the aforesaid order. Accordingly, learned counsel for the petitioners requests for necessary correction in the order.
4. In view of the aforesaid submission, let last line of paragraph no. 4, i.e., 'Petitioners claim clean antecedent.' be treated as expunged from order dated 21.07.2025 passed in Cr. Misc. No. 30051 of 2025 and further six weeks' time from the date of receipt/production of copy of this order is granted to the petitioners to surrender and furnish bail-bond before the court below, subject to deposit of Rs. 5,000/- (Rupees Five Thousand) to the concerned District Legal Services Authority and to furnish its receipt with the bail-bond. This amount may be utilized by the Civil Court concerned in purchase of furniture and beautification of the court premises.
5. Accordingly, modification petition is allowed and order dated 21.07.2025 passed in Cr. Misc. No. 30051 of 2025 is modified to the above extent only.
