JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-09-2019 The present application has been filed for cancellation of anticipatory bail granted to opposite party no.2, vide order dated 13.05.2015, passed in Cr. Misc. No. 22073 of 2015, in connection with Complaint Case No. 681C of 2014, pending in the Court of learned SDJM, Munger. On submission of learned counsel for opposite party no.2 that opposite party no.2 filed Matrimonial Suit No. 135A of 2014 for decree of divorce, wherein learned 3rd Addl. Principal Judge, Family Court, Chhatisgarh directed opposite party no.2 for payment of maintenance amount of Rs. 3,500/- per month to the petitioner, opposite party no.2 was granted anticipatory bail.

Patna High Court CR. MISC. No.5343 of 2017(2) dt.11-09-2019 2/2 Learned counsel for the petitioner submits that the maintenance amount is not being paid by opposite party no.2. In view of this Court, for such a grievance, the petitioner has the remedy to file appropriate application before the Court, which has passed the order of maintenance. There is nothing on record to suggest the misuse of bail. In that view of the matter, this Court is not inclined to interfere.
