The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 30(a) & 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018. 3.
Altogether 97.5 litres and 95.25 litres of illicit foreign liquor is said to have been recovered from two motorcycles.

Learned counsel for the petitioner submits that petitioner is quite innocent and has been falsely implicated in this case due to ulterior motive. He has no concern with the alleged recovered illicit liquor. No incriminating article has been recovered from the conscious physical possession of the
Patna High Court CR. MISC. No.71979 of 2025(2) dt.09-10-2025 2/2 petitioner. It is further submitted that proper procedure of search and seizure has not been followed in this case. It is further submitted that none of the motorcycles from which the recovery of illicit liquor has been made belongs to the petitioner. Petitioner is in custody since 06.09.2025 without having any criminal antecedent.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise Court No.3, Gaya in connection with Excise Sherghati P.S. Case No. 274 of 2025.
