The petitioner apprehends his arrest in Complaint Case No.1604(c) of 2018 for the offences allegedly committed by the petitioner under Sections 323, 406, 417, 504 and 506 of the Indian Penal Code.

The gist of the allegation is that the petitioner received Rs.2 lacs from two cheques and Rs.5,000/- through cash as consideration money for selling two buses to the complainant but the petitioner did not sell the buses to the complainant nor returned the money.

Learned counsel for the petitioner submits that the petitioner is ready to return Rs.2 lacs to the complainant within

Having considered the fact that the petitioner is ready to return the amount received by him, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Bhojpur in connection with Complaint Case No.1604(c) of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, with further condition that the petitioner shall return Rs.

1 lac within one month from the date of this order to the complainant through draft and the remaining Rs.1 lac shall also be returned to the complainant within one month thereafter through draft failing which the learned court below shall cancel the bail bond of the petitioner.
