The petitioner is apprehending his arrest in connection with Pirbahore P.S.Case No.141 of 2016 registered for offences punishable under Sections307 and 34 of the Indian Penal Code. Allegation against the petitioner is that he along with two other accused persons called the informant at Dr.Arun Morari's Lane and when he reached there, the petitioner and other accused persons started firing upon him, however, it is submitted on behalf of the petitioner that there is nothing in the F.I.R. to show that any injury was caused to him and further no motive has been assigned for such occurrence.

Heard learned A.P.P. also.

Having heard both sides and in view of the allegation, to my

Patna High Court Cr.Misc. No.16667 of 2017 (2) dt.12-04-2017 2/2 opinion, it is not a fit case for anticipatory bail rather let the petitioner surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered on its own merit on the same day.

With the aforesaid observation, this application is dismissed.
