The petitioner apprehends his arrest in Ramgarh P.S. Case No. 343/2017, instituted for the offences punishable under Sections 304(B), 201 and 120(B) of the Indian Penal Code. The petitioner is husband of deceased.

In the complaint petition, there is allegation that the petitioner used to torture his wife (deceased) due to nonfulfillment of demand of dowry and also gave threat to the father of deceased on mobile. It is alleged that on 04.11.2017 at about 2:57 P.M., co-accused Om Prakash Gond telephoned the informant that her daughter is serious. When the informant came to the Sasural of her daughter, she found her dead body. It is

Patna High Court Cr.Misc. No.46515 of 2018 (2) dt.24-08-2018 2/2 further alleged that the face and cheek of deceased were black. Thereafter the accused persons disappeared the dead body of her daughter to conceal the evidence.

There is direct allegation against this petitioner in the written report. He is husband of deceased.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. The petitioner is directed to surrender before the Court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, which shall be considered on its own merit without being prejudiced by this order.
