The petitioner seeks bail in connection with Nayagaon P.S. Case No.117 of 2019 registered under Sections 397, 414 and 307 of the Indian Penal Code besides Sections 25(1-b)a and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the informant in his restatement disclosed that the co-accused Samit Kumar informed him that the firearm recovered from his possession was handed over to him by this petitioner. Except that, nothing has been collected by the Investigating Officer against the petitioner in course of

Patna High Court CR. MISC. No.69816 of 2019(2) dt.27-11-2019 2/2 investigation. The petitioner has no criminal antecedent and is in custody since 23.08.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Saran at Chapra, in connection with Nayagaon P.S. Case No.117 of 2019.
