JUSTICE RAJESH KUMAR VERMA ORAL ORDER 29-11-2023 Heard Mr.Pankaj Kumar, learned counsel for the petitioner, learned counsel for the informant and Mr.Awadhesh Kumar Singh, learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Barhara P.S.Case No.355 of 2023, FIR dated 09.06.2023 registered for the offences punishable under Sections 341,323,307,379,34 of IPC.

3. Allegation against the petitioner is that he assaulted to the informant by means of iron rod with intent to kill him causing injury on his head.

As per FIR, allegation against the petitioner is that he assaulted to the informant by means of iron rod and he has received injury. Injury report of the informant suggests that he has received two injuries, one is grievous in nature.

5. Learned A.P.P. for the State, on other other hand, has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid fact and nature of allegation supported by the medical evidence, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Barhara P.S.Case No.355 of 2023 pending in the court of learned C.J.M., Bhojpur at Ara.

7. Prayer is refused.
