2. The petitioner who retired on 31.01.2023 from the post of Deputy Collector, Bihar Administrative Service, has approached this Court for grant of first and second M.A.C.P., which according to the petitioner was entitled on 11.03.2009 and 11.03.2019, respectively. It is the case of the petitioner that the petitioner was entitled to grant of first M.A.C.P. on completion of his 10 years of service on 11.03.2009 and second M.A.C.P. on subsequent completion of another 10 years of service on 11.03.2019. As the petitioner was denied the aforesaid two M.A.C.Ps., the petitioner had filed a representation on 30.05.2024

Patna High Court CWJC No.16962 of 2024(2) dt.12-11-2024 2/2 to the Principal Secretary, General Administration Department, Government of Bihar. The representation dated 30.05.2024 was considered and disposed of by a communication dated 16.07.2024 made to the petitioner by the Under Secretary, General Administration Department, Government of Bihar (Annexure-P/3 of the writ petition) whereby it has been communicated to the petitioner that the petitioner was denied M.A.C.Ps. on account of punishment being imposed upon him in terms of a departmental Letter No. 6642 dated 06.07.2021. The aforesaid communication dated 16.07.2024 made to the petitioner by the Under Secretary, General Administration Department, Government of Bihar has not been challenged by the petitioner in the present writ petition.

3. Under the circumstances this writ petition is disposed of with a liberty granted to the petitioner to challenge the communication dated 16.07.2024 whereby the respondent authorities, after consideration of the representation submitted by the petitioner for grant of M.A.C.Ps. for the period mentioned above have been denied.
