JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioners apprehend their arrest in connection with Sonepur P. S. Case No. 568 of 2019 registered under Sections 143,153 (A), 427, 447, 504 and 506 of the Indian Penal Code. Allegation against the petitioners is that petitioners along with 10-15 unknown persons dismantled the Shiv Temple situated at Ward No. 6 in village- Govindchak. Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case inasmuch as this case has been lodged as a counter blast to the case lodged by petitioner no. 3 bearing Sonepur P.S.Case No. 564 of 2019 dated 26.07.2019 against the informant and others

Patna High Court CR. MISC. No.65283 of 2019(2) dt.04-11-2019 2/3 stating therein that informant along with other accused persons entered upon the land of the petitioner no. 3 and tried to stop the construction being made upon the said land by the petitioner no. 3 and others. He further submits that all the accused persons assaulted the petitioner no. 3 and her family members. He further submits that the present case has been lodged in order to give a colour that petitioners along with some other muslim persons tried to disturb the communal harmony of the village.

On the other hand, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that petitioners along with other accused persons tried to disturb the peace and communal harmony of the village and also ransacked the Shiv Temple situated in the village. Having regard to the submissions made by the parties and taking into consideration the fact that just two days prior to lodging the present FIR, petitioner no. 3 had lodged an FIR bearing Sonepur P.S.Case No. 564 of 2019 against informant & others, I am inclined to grant anticipatory bail to the petitioners. Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs.

Patna High Court CR. MISC. No.65283 of 2019(2) dt.04-11-2019 3/3 sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Sonepur P.S.Case No. 568 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
