JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Goraul P.S. Case No. 185 of 2019, registered for the offences punishable under Sections 376, 307, 34 of the Indian Penal Code and Section 4, 6, 8 of POCSO Act. As per F.I.R. there is allegation against the petitioner of lifting the victim girl and petitioner No. 1 committed physical intercourse with her.
Submission of the learned counsel for the petitioners is that there was love affairs with the petitioner no. 1 and victim girl and in order to pressurize the petitioner No. 1 to perform
Patna High Court CR. MISC. No.69080 of 2019(2) dt.18-11-2019 2/2 marriage present case has been lodged. Now compromise has been made between the parties and petitioner No. 1 has performed marriage with the victim girl.
Heard learned A.P.P. also.
Having heard both sides. In view of the above facts, I am not inclined to grant privilege of anticipatory bail to them, however, they are directed to surrender before the learned Court below and make prayer for regular bail and Court below will consider the matter on its own merit without being prejudiced by order of this court considering the above submission that compromised has been made between the parties. And both parties have filed compromise petition jointly signed by them. Considering the same learned court below shall disposed of the bail prayer of the petitioner.
