2. The petitioner apprehends his arrest in connection with Birupur P.S. Case No. 26 of 2023 registered for the offences punishable under Sections-147, 148, 149, 323, 341, 307, 504, 506/34 of the Indian Penal Code.
3. Allegedly, while the informant returned his home after attending the Bhoj party, the accused persons assaulted the informant,as a result of which, his hand was broken. It is further alleged that when two other persons came to rescue the informant, they were also assaulted.
4. Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. There is case and
Patna High Court CR. MISC. No.73292 of 2023(2) dt.09-11-2023 2/2 counter case between the parties and injuries suffered by both the injured persons are simple in nature. Learned counsel for the petitioner has also submitted that the case lodged by the petitioner against the prosecution side, is earlier than the present case and Khushbu Kumari, who is a member of defence side, has suffered grievous injury.
5. Learned Additional Public Prosecutor opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of their arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Birupur P.S. Case No. 26 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
