JUSTICE SHIVAJI PANDEY ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are apprehending their arrest in connection with Kako P.S. Case No. 05 of 2017 registered for offences under sections 379/34 of the Indian Penal Code.
In the present case, the petitioners have a criminal antecedent of serious offence.
Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.
Accordingly, the prayer for anticipatory bail of the
Patna High Court Cr.Misc. No.19192 of 2017 (3) dt.06-07-2017 petitioners, namely, Rameshwar Yadav @ Ram Ishwar Yadav, Amaresh Yadav and Bhim Yadav is rejected.
If the petitioners surrender before the court below within a period of four weeks from today, the court below is directed to consider the case in accordance with law and will decide the prayer for grant of regular bail without being influenced by this order.
