The petitioner seeks anticipatory bail in connection with Samho P.S. Case No. 10 of 2018, registered for offences punishable under Sections 452, 380, 323, 354, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., allegation against the petitioner is that the informant and petitioner are on inimical terms and it is alleged that the petitioner along with some other accused persons entered into the house of the informant and they have tried to assault the informant, but anyhow he fled away. It is also alleged that the petitioner and other persons also assaulted the wife of the informant and snatched one golden chain. Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the

Patna High Court Cr.Misc. No.44454 of 2018(2) dt.27-07-2018 2/2 petitioner and there is no injury on any person. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Samho P.S. Case No. 10 of 2018 to the satisfaction of learned S.D.J.M., Begusarai, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
