Petitioner apprehends his arrest in connection with Shankarpur P.S.Case No. 64 of 2018 registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

Allegation against the petitioner is of keeping huge amount of Rs.17,86,415/- in cash in hand and as such complaint was lodged by Circle Officer and even show cause was asked from him and it is alleged that this is a case of defalcation. Submission of learned counsel for the petitioner is that he has already deposited the whole amount which will appear from the impugned order itself and he has no intention to defalcate the same.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Madhepura, in connection with Shankarpur P.S.Case No. 64 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
