2. The petitioner is in custody since 10.08.2023 in connection with Magadh Medical P.S. Case No. 237/2021 registered for the offence punishable under Sections 325/341/307/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. Later on, Section 302 of the Indian Penal Code was also added.

3. As per the prosecution case, one Jitendra Kumar hired criminals and got the deceased killed brutally. The petitioner is also said to have been a part of the crime.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail after framing of charge, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Gaya in connection with Magadh Medical P.S. Case No. 237/2021.

7. If there is delay in framing of charge because of non-appearance of the other accused, the trial Court will separate the trial of the petitioner and frame the charges against him.
