JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Complaint Case No. 876 of 2014, registered for offences punishable under Sections 420/34 of the Indian Penal Code. As per F.I.R., allegation against the petitioners is that they sold the land to the Complainant and thereafter, he came to know that the land already sold to one Kanhaiya Ram, through a notice of the learned lower Court, Bhabua.
Submission of the learned counsel for the petitioners is that they have been falsely been implicated in this case and the allegations against the petitioners is false and concocted.
Patna High Court Cr.Misc. No.44572 of 2018 (2) dt.31-07-2018 2/2 Learned A.P.P. as well as learned counsel appearing on behalf of the informant oppose the prayer for bail on the ground that the petitioners have already sold the land to the Complainant but he is not returning money.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Complaint Case No. 876 of 2014, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
