The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 304(B), 34 of the Indian Penal Code.

As per prosecution case, informant alleged that her daughter was married to, namely, Deepak Kumar Singh. After marriage, for a new car her daughter was being tortured and murdered by this petitioner along with co-accused persons, after that this case has been lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Petitioner is mother-in-law of the deceased and she was living separately

Patna High Court CR. MISC. No.71634 of 2022(2) dt.17-03-2023 2/2 from the deceased as well as her husband rather she has falsely been implicated in this case. The husband of the deceased is already in judicial custody upon whom the main responsibility to keep his wife with proper dignity. Petitioner has no concern mess and business with the deceased and she has got no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 20.08.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as the custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shyampur Bhataha P.S. Case No. 146 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Ist- Sheohar.
