The petitioners are apprehending their arrest in a case registered under Section 304(B)/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioners caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioner No.1 is the Devar and petitioner No.2 is the Nanad of the deceased. They are separate in mess

Patna High Court Cr.Misc. No.48853 of 2018(2) dt.26-10-2018 2/2 and property from the husband of the deceased. The husband of the deceased has already been acquitted by the court below. On behalf of the State, it is submitted that the petitioners are named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Darbhanga in connection with Jalley P.S. case No.178 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
