2. The petitioner is apprehending his arrest in connection with Daraunda P.S. Case No. 342 of 2023, F.I.R. dated 13.11.2023 for the offences punishable under Sections 341, 323, 324, 325, 379, 504/34 of the Indian Penal Code.
3. According to prosecution case, this petitioner along with other accused person in a drunken condition demanded money from the informant and when the informant refused to do so, then this petitioner gave knife blow on the eye of the informant causing him grievous injury.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.74964 of 2024(4) dt.28-04-2025 2/2 petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.
5. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R, it appears that there is direct and specific allegation of assault against the petitioner and the injury report of the injured person suggest that the injury is grievous in nature. Apart from that the petitioner carries one criminal antecedent other than the present one.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Daraunda P.S. Case No. 342 of 2023 pending in the court of Chief Judicial Magistrate, Siwan.
7. Prayer is refused.
