JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Aurangabad (Town) P.S. Case No. 379 of 2018 registered for the offences punishable under Sections 420, 379 and 411 of the Indian Penal Code.

As per FIR there is allegation of snatching of tempo by some miscreants and petitioner is not named in the FIR. It further appears from the impugned order that the tempo was recovered from in front of house of the petitioner. Submission of learned counsel for the petitioner is that after six months the name of petitioner has come during investigation in the confessional statement of co-accused and tempo was not recovered from his house, rather in front of his house.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
