The petitioner apprehends his arrest in Daraunda P.S. Case No. 147/2017, instituted for the offences under Sections 304(B), 201 and 120(B) of the Indian Penal Code. The petitioner is the husband of the deceased. It is alleged in the written report that the deceased was married with this petitioner on 25.04.2016 and she died her unnatural death in her Sasural on 29.07.2017 for non-fulfillment of demand of dowry. Learned counsel for the petitioner has submitted that the F.I.R. has been lodged after delay on 04.08.2017. It has also been submitted that the deceased was suffering from mental disease and she has committed suicide by hanging herself. The villagers brought
Patna High Court Cr.Misc. No.39204 of 2018 (3) dt.24-07-2018 2/2 her dead body out after breaking the door and on the advice of family members, her dead body was disposed of.
Case diary has been received.
Learned Additional P.P. opposed the prayer for bail of the petitioner. He has submitted after verifying the case diary that the deceased was being tortured by her husband and other in-laws for demand of dowry and she died unnatural death in her Sasural. Her dead body was disposed of without properly informing the family members of the deceased.
Considering the aforesaid fact and circumstances, the anticipatory bail petition of the petitioner is rejected. (Sanjay Priya, J.) Rakhi U T
