JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Banka (Barahat) P. S. Case No. 449 of 2019 disclosing offences under Sections 147, 149, 387, 504, 506, 34 of IPC.

In view of the submission of learned counsel for the

Patna High Court CR. MISC. No.68174 of 2019(2) dt.16-01-2020 2/3 petitioner that petitioner no.5 has been arrested during the pendency of this application. As such, this application is dismissed as withdrawn on behalf of petitioner no.5. As per prosecution case there is demand of Rs.10 lakhs as extortion and also of firing, but that does not hit anybody.

Submission of the learned counsel for the petitioners is that there is a title suit going on between the parties, in which, the injunction has been granted against the informant, but in order to pressurize the petitioners, this false and concocted case has been lodged. No any injury to any person has been received. Heard learned A.P.P. also.

Having heard both sides, considering the submissions made above, let the petitioners, except petitioner no.5, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Banka, in connection with Banka (Barahat) P. S. Case No. 449 of 2019.
