JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Chandi P.S.Case No. 87 of 2018, registered for offences punishable under Sections 25 (1-b)a, 26/35 of Arms Act. As per F.I.R., allegation against the petitioner is that after search of the house of the petitioner, two country made katta/pistol and eleven live cartridges were recovered from the beneath of the bed of petitioner and cash of Rs. 37,000/- and a seizure list was prepared.

Submission of the learned counsel for the petitioner is that the petitioner is wife of Muneshwar Paswan and no recovery has been made from the possession of the petitioner and the petitioner has falsely been implicated in this case as she is wife

Patna High Court Cr.Misc. No.45672 of 2018 (2) dt.06-08-2018 2/2 of accused Muneshwar Paswan and fire arms were recovered from the house of Muneshwar Paswan. It is further submitted that the petitioner has no criminal antecedents.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest with six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nalanda in connection with Chandi P.S.Case No. 87 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
