The petitioner has renewed his prayer for bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a) & (d) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted, various utensils for manufacture of liquor and 8 litres of country liquor was recovered from the petitioner's house.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. In the earlier order of rejection dated 9.6.2022 passed in Cr. Misc. no. 1572 of 2022, liberty was granted to the petitioner to renew his

Patna High Court CR. MISC. No.71936 of 2022(2) dt.21-12-2022 2/2 prayer for bail on completing on year in custody. He is in custody since 7.11.2021.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submission made on behalf of the petitioner together with the petitioner having remained in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Atri P.S. Case no. 370 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no. 1, Gaya.
