The petitioners were granted the privilege of anticipatory bail by order dated 21.09.2017 passed by a Bench of this Court in Cr. Misc. No. 44290 of 2017 subject to the condition of their surrendering before the Court below within four weeks from the date of receipt/production of a copy of the order referred to above.
The learned counsel for the petitioners has submitted that the mother of petitioner No. 1 was seriously ill and the petitioner No. 1 had to remain busy for her treatment whereas petitioner No. 2 was assisting petitioner No. 1 all this while in the treatment of his mother. Precisely for this
Patna High Court Cr.Misc. No.38627 of 2018 (3) dt.25-07-2018 2/2 reason, the petitioners could not surrender before the Court below. Hence, modification of the order referred to above has been prayed for.
Regard being had to the facts of this case, the order dated 21.09.2017 passed in Cr. Misc. No. 44290 of 2017 is modified to the extent that if the petitioners surrender before the Court below within a period of four weeks from today, they shall be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (ten thousands) with two sureties of the like amount each to the satisfaction of the Court concerned.
With the aforesaid modification of the order dated 21.09.2017 passed in Cr. Misc. No. 44290 of 2017, the petition is disposed of.
