20-11-2019 Heard learned counsel for the parties.

The petitioner, apprehending his arrest in Manpur P.S. Case No. 92 of 2019 registered for the offence under Sections 379, 120(B) of the Indian Penal Code, Section 4/21 of M.M. (D.R.) Act, 4/40 of Bihar M.M.C.Rules and 6,4,5(a),5(c),8(a) of B.M.P.I.M.T.S. Rules 2003, has prayed for grant of bail. The prosecution case is that on secret information, the informant alongwith police personnel went to check illegal transportation of sand and they found about 10,000 C.F.T. sand has been illegally stored and accordingly, an F.I.R. was lodged against 13 accused persons, which includes the petitioner. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner and due to village politics, petitioner has been named as accused in the F.I.R. He

Patna High Court CR. MISC. No.73022 of 2019(2) dt.20-11-2019 2/2 further submits that petitioner has no concern with the seized sand and he has no criminal antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner above named be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Nalanda at Biharsharif in connection with Manpur P.S. Case No. 92 of 2019 on following conditions:

(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tempers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
