The petitioners apprehend their arrest in connection with Jakkanpur P.S. Case No. 375 of 2017 for the offence under Sections 363/365 of the Indian Penal Code.
From perusal of the F.I.R., it would appear that the husband of informant was on way to Patna, but he did not reach Patna and his whereabout was not traceable. From the statement of the informant, it would be evident that the informant tried to contact one Rajan Kumar with whom the husband of the informant left for Delhi for job and failure of the husband to reach the destination and non-response of Rajan Kumar, the
Patna High Court Cr.Misc. No.48648 of 2018(2) dt.11-12-2018 2/2 present case has been registered.
Considering the fact that the petitioners are family members and there is no material that they were directly or indirectly involved in missing of the husband of the informant, which is the subject matter of lodging of the present case, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Judge-I, Patna in connection with Jakkanpur P.S. Case No. 375 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
