Petitioners apprehend their arrest in connection with Chapra Mufassil P.S. Case No.687 of 2021, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325, 307, 332, 353 and 427 of the Indian Penal Code. Accusation is of creating nuisance causing anarchy at the place of occurrence and the counting of the election was also disrupted.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as
Patna High Court CR. MISC. No.72230 of 2022(2) dt.21-03-2023 2/2 stated in paragraph-3 of the bail petition. It is further submitted that the petitioners are not named in the FIR. It is submitted that the petitioners are made accused in the present case because the motorcycle of the petitioners was recovered from the place of occurrence.
The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Considering the fact that there is general and omnibus allegation against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Saran at Chapra in connection with Chapra Mufassil P.S. Case No.687 of 2021, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
