JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2018 The petitioner is apprehending his arrest in connection with Budha Colony P.S. Case No. 70/18, registered for offences punishable under Sections 467, 468, 471, 420 and 34 of the Indian Penal Code.
Allegation against the petitioner is of securing appointment as constable driver on the basis of forged certificate of intermediate.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and in fact the intermediate certificate submitted by the petitioner from Gramin Mukt Vidyalaya Shiksha Sansthan is genuine one and the same is recognized by the Himachal Pradesh Board of School Education, Dharamshala.

No.48405 of 2018 (2) dt.24-08-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on provisional bail till submission of charge-sheet on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Subordinate Judge - XVI - cum- the Additional Chief Judicial Magistrate, Patna in connection with Budha Colony P.S. Case No. 70/18, subject to the conditions as laid down under Section 438(2) of the Cr.P.
C, as well as with the condition that petitioner will cooperate in investigation and shall produce the necessary documents before the Investigating Officer. It is made clear that after submission of charge-sheet, if the allegation against the petitioner is found to be true, the petitioner shall surrender before the court below and pray for regular bail, which will be considered on the merit of the case. With the aforesaid observation, this application is disposed of.
