The petitioner seeks bail in connection with Ashok Paper Mill P.S. Case No. 26 of 2018, registered for offence punishable under Sections 147, 341, 323, 315 and 504 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that there is admitted land dispute between the parties and there is inordinate delay of 40 days in lodging FIR without plausible explanation. He further submits that other co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order
Patna High Court CR. MISC. No.65076 of 2019(2) dt.04-11-2019 2/2 dated 03.04.2019 in Cr. Misc. No. 20750 of 2019 and order dated 16.04.2019 in Cr. Misc. No. 23700 of 2019. The petitioner has no criminal antecedent and he is in custody since 23.08.2019.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Darbhanga in connection with Ashok Paper Mill (A.P.M.)
