JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Nardiganj P.S. Case No. 107 of 2014, registered for offences punishable under Sections 323, 504, 354, 379, 376 and 511 of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is of tried to commit rape upon the informant.

Submission of the learned counsel for the petitioner is that complaint petition had been sent for registration to Nardiganj P.S. under Section 156 (3) Cr.P.C. and charge sheet has been submitted and cognizance has been taken against the petitioner under Sections 341, 323, 354 I.P.C. and the present case has been lodged by the informant to retaliation of the case, which was filed

Patna High Court Cr.Misc. No.47532 of 2018 (2) dt.16-08-2018 2/2 by the petitioner as Nardiganj P.S.Case No. 96 of 2014, just in order to save his skin. It is further submitted that the petitioner has no criminal antecedent.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Nawada in connection with Nardinganj P.S.Case No. 107 of 2014, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
