2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 318(4) & 316(2) of the BNS and under Section 66(c)(d) of the I.T. Act.
3. The case of the prosecution in short is that the petitioner has taken Rupees 60 Lakh through RTGS for transferring some land in favour of the informant.
4. During course of hearing, learned counsel for the Opposite Party No.2 is also present and both, learned counsel for the petitioner and learned counsel for Opposite Party No.2 agreed that the petitioner will pay Rupees 40 Lakh and out of this

No.70891 of 2025(2) dt.14-10-2025 2/2 Rupees 40 Lakh, the petitioner will pay Rupees 07 Lakh to the informant in cash or through draft at the time of furnishing bail bond and rest amount will be paid @ Rs. 03 Lakh per month and if the petitioner will make default in payment for two consecutive months, the learned trial court will be at liberty to cancel the bail bond of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 26.03.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with the conditions mentioned above and with a condition that one of the daughter of the petitioner shall be the bailor. The above named petitioner is directed to be released on bail in connection with Rupaspur P.S. Case No. 564 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Danapur, Patna.
