JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Hisua P. S. Case No. 133 of 2018, disclosing offences under Sections 341, 323, 307, 379, 385, 504, 506, 34 of IPC and Section 27 of the Arms Act.

As per F.I.R. petitioner is said to have assaulted the informant on head by rod and there are allegation against other accused persons also.

Submission of the learned counsel for the petitioner is that after investigation police has not found the case true against this petitioner. However, the learned Magistrate, has taken cognizance of the occurrence against this petitioner also. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that injury was found to be grievous in nature, which will appear from the impugned order also.

No.64823 of 2019(2) dt.17-10-2019 2/2 Having heard both sides, in view of the facts, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit, without being prejudiced by order of this Court.
