Petitioner apprehend his arrest in a case registered for the offence punishable under Sections 147, 149, 337, 323, 435, 436, 427, 307, 332, 295A, 333, 353, 153A, 379 read with Section 120B of the Indian Penal Code.

Allegation against the petitioner is of being a member of the mob of 130 persons and setting ablaze public property. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on suspicion. Nothing incriminating has been recovered from the possession of the petitioner. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 08.02.2019 in Criminal Miscellaneous

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Aurangabad Town P.S. Case No. 98 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
