The petitioner seeks bail in connection with Desari (Sahdei O.P.) P.S. Case No.485 of 2022 registered for the offence under Sections 302, 201 and 120(B) of the Indian Penal Code.

The allegation against the petitioner is to have committed murder of sister of the informant along with other co-accused persons.

Learned counsel appearing on behalf of the petitioner submitted that petitioner is an old lady of 65 years and she has falsely been implicated in the present case. He submitted that petitioner is mother-in-law of the deceased, who

He has further submitted that there is no specific allegation is against this petitioner, where, specific allegation is against the husband of the deceased. He has further submitted that petitioner is in custody since 22.05.2023. He has further submitted that similarly situated co-accused persons have already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 24.08.2023 passed in Cr. Misc. No. 44156 of 2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court, let the petitioner, above named, is directed to be released on bail in connection with Desari (Sahdei O.P.) P.S. Case No.485 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur.
