2. The petitioner seeks regular bail in a case registered for the offence under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a, 26(i) and 35 of the Arms Act.

3. As per the prosecution case, petitioner has been found preparing for loot and one country made pistol and two live cartridge have been recovered from the petitioner. Petitioner is accused of nine cases of similar and serious nature.

4. Learned counsel for the petitioner submits that petitioner has been acquitted in six cases and effectively petitioner now has three criminal antecedent and the petitioner is in custody since 10.07.2023.

5. Considering the period of custody and the recovery, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XV, Gopalganj/concerned Court below in connection with Mirganj P.S. Case No. 264 of 2023 subject to condition that:- 6(i). The petitioner shall mark his attendance at the Srirampur Police Station, Deoria on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. 6(ii). The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.

7. Let a copy of this order be communicated to the Superintendent of Police, Deoria, Uttar Pradesh through FAX for its compliance forthwith.
