JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-04-2023 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with respect to Kiran Devi @ Sudha Devi petitioner no. 1, as during pendency of this case, petitioner no. 1 has already been arrested. Permission is accorded. The anticipatory bail application with respect to petitioner no. 1 is dismissed as withdrawn having become infructuous.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 353 and other allied sections of the Indian Penal Code.

Patna High Court CR. MISC. No.72028 of 2022(2) dt.06-04-2023 2/2 Allegation against this petitioner is that petitioner along with other FIR named accused persons attacked on the police party and injured some police personnel by hurling brickbats and pelting stones and hitting lathi. Petitioner has been identified by the local Chowkidar.

It is submitted that there is general and omnibus allegation and no specific overt act has been alleged against this petitioner. Petitioner claims clean antecedent. Considering the facts aforesaid, the Dhrub Paswan petitioner no. 2 above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Patnacity, Patna in connection with Daniawan P.S. Case No. 114 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
