2. Petitioners apprehend arrest in a case registered for the offence punishable under sections and other allied sections 307/379/34 and other allied sections of the Indian Penal Code.
3. As per the prosecution case, petitioner no.1 assaulted with dabia on the head of the informant, whereas petitioner no.2 assaulted the informant with iron rod causing fractuare injury in the finger of left hand of the informant. Injury caused by petitioner no.1 has been found to be simple in nature, while petitioner no.2 caused grievous injury to the informant.
4. Considering the nature of injury, prayer for bail of the petitioner no.1 is allowed. In the event of arrest/surrender within six weeks from today, let petitioner no. 1, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Benipatti, Madhubani in Benipatti Police Station Case No. 87 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
5. However, considering the nature of injury caused
