1. Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner is named in the F.I.R. and apprehending his arrest in connection with C.R. No. 897 of 2022, T.R. No. 1010 of 2023 registered for the offences punishable under Sections 323, 420, 468 and 504 of the Indian Penal Code.

3. The allegation against the petitioner is to

Patna High Court CR. MISC. No.79916 of 2023(4) dt.07-03-2024 2/3 cheat complainant alongwith other co-accused persons, while executing sale deed for the piece of land as described in bail petition.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is not the beneficiary of the alleged transaction and his implication is appearing only being scriber of the said sale deed in his professional capacity. While concluding the argument it is submitted that petitioner is a man of clean antecedent.

5. Learned APP duly assisted by learned counsel appearing on behalf of O.P. No. 2, while opposing the prayer for bail submitted that petitioner is scriber of the said sale deed.

In view of the facts and circumstances as mentioned above and by taking note of the fact, as petitioner is not the beneficiary of the sale deed and his implication appears only being scriber, accordingly the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period

Patna High Court CR. MISC. No.79916 of 2023(4) dt.07-03-2024 3/3 of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Samastipur/concerned Court where the case is pending in connection with C.R. No. 897 of 2022, T.R. No. 1010 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
