JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Goraul (O.P. Kathara) P.S. Case No. 376 of 2018, disclosing offences under Sections 394, 302, 34 of IPC and Section 27 of the Arms Act.
As per F.I.R. when the two staffs of the petrol pump were going on by motorcycle, during the way, they have intercepted by some miscreants and there was some scuffle of snatching bag containing the amount and for that, one of the staff has received injury and later on, he died. Petitioner is not named in the F.I.R. Later on, his name transpires in the confessional statement of the co-accused.
Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against the petitioner.
Patna High Court CR. MISC. No.64937 of 2019(2) dt.18-10-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that case is not only under Section 394 IPC but also under Section 302 of IPC. In this case the custodial interrogation of the petitioner is required for TIP, as such, this is not a fit case for grant of anticipatory bail. Having heard both sides, in view of the allegations, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner.
