The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition of Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner and the recovery has been made from the house of Prabhat Sharma and Pramod Sharma. But the petitioner has been made accused in other three cases in the same offences.

In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Hulasganj

Patna High Court CR. MISC. No. 65581 of 2019(2) dt.13-11-2019 2/2 P.S. Case No. 164 of 2018 from the Court of learned Special Judge, Excise, Jehanabad.

Accordingly, the application is disposed.

However, petitioner is directed to surrender before the learned court below and make prayer for bail. The learned court below shall dispose of the bail petition on the same day without being prejudiced by the order of this Court.
