JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Hajipur Sadar P. S. Case No. 455 of 2019, disclosing offence under Section 414 of IPC.

As per F.I.R. the stolen motorcycle was recovered from the possession of co-accused and he has said that petitioner has given the motorcycle to him.

Submission of the learned counsel for the petitioner is that F.I.R. itself shows that there is no recovery from his house and he has been made accused on the confessional statement of the co-accused. He has no criminal antecedent. He is student preparing for the competitive examinations.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

Vaishali, Hajipur, in connection with Hajipur Sadar P. S. Case No. 455 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
